These Terms and Conditions govern the use of the Thanks For The Memories website and the purchase of products from us. Thanks For The Memories is based in Tauranga, New Zealand.

By using this site you confirm that you have read, understood, and agree to be bound by these Terms and Conditions at all times.

Intellectual property

All content published and made available on our site is the property of Thanks For The Memories, including but not limited to images, text, logos, and all other material that contributes to the composition of our site.

Artwork on the Hiriwā Digital Art magnets is the property of Hiriwā Digital Art and is used with permission.

By uploading photos through our service, you confirm that you own or have the right to use those photos for this purpose, and you grant us a limited licence to reproduce those photos solely for the purpose of fulfilling your order.

Accounts

When you create an account you agree to:

• Take sole responsibility for your account and the security of your password and login details
• Ensure all personal information you provide is accurate, up to date, and truthful
• Update your personal information promptly if it changes

We reserve the right to suspend or terminate your account if you are using our site illegally or in violation of these Terms and Conditions.

Products and custom orders

Thanks For The Memories produces custom photo magnets to order. Our products include:

• Single custom photo magnets
• Custom photo magnet packs (4, 6, 9, and 12 magnet sets)
• Ready-made art magnets designed by Hiriwā Digital Art, sold through our site in collaboration with the artist

Because custom photo magnets are made to order using photos you supply, please ensure your photos meet our minimum quality requirements before ordering. We display a resolution warning on our site if an uploaded photo may not print well.

All product descriptions and images on our site are as accurate as possible. We reserve the right to modify, reject, or cancel your order if necessary. If we cancel your order after payment has been processed, we will issue a full refund.

Payments

We accept the following payment methods:

• Credit and debit cards (Visa, Mastercard)
• Apple Pay and Google Pay
• Afterpay

All payments are processed securely by Stripe. Afterpay purchases are also subject to Afterpay's own terms. We do not store your card details. By providing payment information you authorise us to charge the amount due for your order. All prices are in New Zealand dollars (NZD) and include GST where applicable.

If we believe a payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse the transaction.

Shipping and delivery

We offer the following delivery options within New Zealand:

• Free local drop-off in Tauranga
• NZ-wide tracked courier — NZ$10 flat rate, 2–5 working days (4–8 for rural)

Delivery times do not include weekends or statutory holidays. You are required to provide a complete and accurate delivery address. We are not liable for delivery to the wrong address due to inaccurate information provided by you.

Consumer protection law

Where the Consumer Guarantees Act 1993, the Contract and Commercial Law Act 2017, or any other applicable New Zealand consumer protection legislation applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. The mandatory provisions of that legislation will apply.

Limitation of liability

To the extent permitted by law, Thanks For The Memories and its directors, officers, agents, and employees will not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of our site or products, except where such liability cannot be excluded by New Zealand law.

Indemnity

To the extent permitted by law, by using this site you indemnify and hold harmless Thanks For The Memories and its directors, officers, agents, and employees from any actions, claims, losses, damages, liabilities, and expenses arising from your use of our site or your violation of these Terms and Conditions.

Applicable law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising in connection with these Terms and Conditions will be subject to the jurisdiction of the New Zealand courts.

Changes to these terms

We may amend these Terms and Conditions from time to time to reflect changes in our operations or to maintain compliance with New Zealand law. We will notify users by posting the updated terms on this page.
